Wardrobe Malfunction Fine Re-Examined: Janet Jackson

It was back in 2004, that Michael Jackson’s sister Janet Jackson first hit the headlines for her infamous Super Bowl wardrobe malfunction. And now it appears to be hitting the headlines again, after US court officials decided to re-examine the $550,000 fine that was initially given to the CBS network.

According to a report at femalefirst.co.uk, CBS bosses aired Janet Jackson’s half-time performance at the 2004 Super Bowl game. It was during this aired half-time performance that Justin Timberlake ripped off part of Jackson’s top, to reveal an almost bare breast underneath.

The original indecency case was actually thrown out on the grounds that the Janet Jackson breast-baring incident, which only lasted nine-sixteenths of a second, was too fleeting to warrant a fine. But the issue was returned to court in May of 2009, when a judge asked for the fine to be reconsidered.

This directed officials at the 3rd U.S. Circuit Court of Appeals in Philadelphia, to re-open the investigation. The proceedings to consider whether the Federal Communications Commission (FCC) fine is permissible or not, apparently began on Tuesday 23rd, February.
