Dua Lipa, who charted Levitating as a top single in 2020, is being sued once more. A complaint was filed with Manhattan federal court Friday.
The 26-year-old singer has been accused of copying L. Russell Brown’s 1979 song “Wiggle and Giggle All Night” along with Sandy Linzer’s 1980 hit “Don Diablo”, according to The Hollywood Reporter.
It follows reports that she was hit with a lawsuit by a band called Artikal Sound System who are seeking to claim the profits from her track because they believe she has taken inspiration from their 2017 reggae single Live Your Life.

Lawyers for Russell and Sandy are said to have written in the new complaint: ‘Defendants have levitated away plaintiffs’ intellectual property. The plaintiffs are suing to stop defendants from obstructing their willful infringement.
The Grammy-winning artist was interviewed by the press and said that she had consciously copied eras past, and was inspired to create a retro sound.
Naming defendants Warner Music Group, as well as collaborator DaBaby, and other contributors, they continued: ‘In seeking nostalgic inspiration, defendants copied plaintiffs’ creation without attribution.’

According to the new lawsuit, the ‘signature melody’ which plays out before Dua sings the first verse copied a similar portion of the two tracks.
They also claimed that the section in question was “crucial” because it became a viral sensation via TikTok.
Lawyers stated that the signature melody was the most recognized and heard part of infringing works. It plays an important role in the success of their music.

Video creators often cut short the sound clips on TikTok so the trademark melody is usually fifty percent of viral videos.
It comes after documents obtained by TMZ, the band believe Dua and her team heard Live Your Life and came up with a carbon copy in Levitating.
Although the plaintiffs have not explained the reasons for their belief in this case, they do recognize similarities in the song’s sound, especially in the choruses.
