Jeffrey Epstein’s 2009 settlement with Virginia Roberts was not sealed. But it does not include Prince Andrew, as his legal team had intended to disallow the lawsuit against him. 

Andrew’s attorneys claimed that the agreement would stop Giuffre’s battery case she brought against him in 2020, as it exempted him of any liability for future cases.

However, the document does not name Andrew and doesn’t mention “royalty” as a category like his lawyers suggested.

The Duke appears to be relying instead on a vague group of ‘other possible defendants’ that he believes includes him. 

Virginia Giuffre signed the settlement in 2009 after she settled a case of Jeffrey Epstein’s sex abuse. 

Lewis Kaplan of the New York Federal Court will determine Tuesday whether the settlement could be used to dismiss Giuffre’s lawsuit against Andrew.

Giuffre (38-year-old mom-of-three) sued Andrew in New York federal court for battery and infliction emotional distress in July.

At Epstein’s request, she claimed she had to have sex in the Duke’s presence three times in 2001.

Andrew strongly denied her claims, and said that she was after “another payday at His expense”.

This news comes at an awful time for the Duke. Last week, his old friend Ghislaine maxwell was found guilty of recruiting and trading underage girls to Epstein.

At her sentencing, she will spend up to 65 years behind bars.

Giuffre’s agreement with Epstein shows that she paid $500,000 to settle any claims against her.

Giuffre signed a 12-page agreement releasing Epstein’s “agent(s), attorney (s), predecessor(s), successor[s], heir[s], administrator(s), assign[s], and/or employee[s]”.

Giuffre also agreed to release ‘any other person or entity who could have been included as a potential defendant (‘Other Potential Defendants’) from all, and all manner of, action and actions of Virginia Roberts, including State or Federal, cause and causes of action (common law or statutory), suits…and demands whatsoever in law or inequity for compensatory or punitive damages’.

Andrew is not mentioned, nor are other categories of persons like “royalty”, even though this was suggested by the Duke in response to Giuffre’s lawsuit.

In that document the Duke’s lawyer Andrew Brettler argued that ‘because Prince Andrew falls within the specific categories of individuals who (redacted) in the Epstein Action – i.e., ‘royalty’ the Court must dismiss her claims here in light of the plain language of the Release Agreement’.

Brettler claimed that Giuffre had dismissed the battery claim against Alan Dershowitz’s lawyer, after which he brought the same agreement. She should also do so for Andrew.

Last week, the Duke experienced a setback as Judge Kaplan denied his request for a halt to the case on grounds Giuffre does not live in the US.

Andrew tried various technical arguments to stop the case. He also claimed that the law under which the case was brought is not constitutional.

For weeks the Duke refused service, until Judge Kaplan challenged British legal authorities and ordered them to act.

The lawsuit will move into discovery, and Giuffre’s attorneys have already requested documents to prove Andrew’s absurd claim that he does not sweat during an interview.

This was said by the Duke to be evidence that he did not have a night of dancing in a London club with Giuffre before they had sex in 2001, as Giuffre claims.

Giuffre seeks unspecified damages. However, there are rumors that the amount could reach into the thousands of dollars.

She alleges that Epstein, a disgraced financier, trafficked her to have sex and she did so when Andrew was 17 years old. Andrew is a minor according to US law. 

It was claimed that Buckingham Palace “sleeped” into Prince Andrew’s crisis, and is now paralyzed by indecision about how to deal with it.

Sources close to the royal family claim that the Duke operated in ‘impunity” as a Royal Family member because his staff was too scared to confront him.

The idea that he might still make it to the public eye, even with the ongoing controversy over his friendship and affair with Jeffrey Epstein must be rejected.  

Friday was the first day that Maxwell was publicly seen since Epstein was sentenced to multiple child sex offences for Maxwell.

Interviewer Emily Maitlis was also interviewed by Roberts in his Newsnight interview. He said that Roberts claims they slept together in London but in fact he was at a Pizza Express near Woking on Roberts’ date. According to his interviewer, he has also been asked for proof.

Miss Roberts is now Giuffre and claims that she had slept with Andrew three more times in 2001. This was at the time she was 17, when Epstein controlled her.

He strongly denied the allegations. After Maxwell’s conviction, the pressure has intensified on Maxwell.

A senior royal advisor spoke on condition anonymity to say that although no one outside the Prince’s personal office knew the extent of his friendship with Maxwell and Epstein, it was an ongoing issue for the Royal household.

Prince Andrew came under fire after he was spotted taking a stroll through New York's Central Park with Epstein following his prison term in 2011

After his 2011 sentence in prison, Prince Andrew was seen taking a walk through New York’s Central Park together with Epstein.

‘Anyone who even dared to offer their professional advice that maybe his way wasn’t the right one was met with a decisive ‘f*** off out of my office’,’ the source said.

Other former royal staff back up the account, claiming that the prince behaved as though he didn’t need to answer anyone and allowed himself to “go rogue”.

Andrew’s role in roving trade “ambassador” was particularly problematic, according to some reports. This saw him being repeatedly attacked for working with controversial businessmen and world leaders.

Former Buckingham Palace staffer recalled that it was a difficult task to get the prince and his advisers to accept any instruction. They said that the duke had made it clear to them that the Queen was his only source of information.

Andrew took a break from official duties after the Newsnight interview. However, insiders claimed that it was “unsatisfactory” for Andrew to return to public life. According to them, ‘It would make everyone’s lives easier to stop the boiling now and end it all for good.

Andrew will attempt to get Miss Roberts’ case dismissed on Tuesday.

Her legal team filed court papers on Friday to clarify that they will test her Newsnight alibi. On Friday, he denied her claims that he was sweating during their dance in London nightclubs. Instead, he claimed that he had a peculiar medical condition’ making it difficult for him not to sweat. 

His lawyers want him to show proof of his “alleged medical condition, anhidrosis”.

They could also ask his ex-police bodyguards for testimony about whereabouts of the duke at the time Miss Roberts claims they had sex. Buckingham Palace did not respond to Miss Roberts’s request for comment.
